LIMITED WARRANTY
THE FOLLOWING WARRANTY FOR EMP’S OIL MATE WITH AUTO-SHUTOFF IS EFFECTIVE AS OF
SEPTEMBER 1, 2003
EXPRESS WARRANTY OF FITNESS OF PARTICULAR PURPOSE:
EMP HEREBY EXPRESSLY WARRANTS THAT THE OIL MATE IS MERCHANTABILE AND FIT FOR BUYER’S
PARTICULAR PURPOSES.
EXPRESS AND EXCLUSIVE AGREEMENT AS TO SELLER’S LIABILITY:
EMP HEREBY EXPRESSLY AGREES TO LIABILITY TO THE EXTENT OF RETURN AND REPAYMENT OF PURCHASE
PRICE OR REPAIR AND REPLACEMENT OF EMP’S NONCONFORMING GOODS OR PARTS. ADDITIONALLY, EMP HEREBY
EXPRESSLY AGREES TO BE LIABLE FOR ENGINE REPAIR OR REPLACEMENT PRIMARILY CAUSED BY, IN EMP’S
SOLE AND EXCLUSIVE JUDGMENT, A PROPERLY INSTALLED OIL MATE PRODUCT OR PART THEREOF FOR A PERIOD
OF TIME NOT TO EXCEED THE ORIGINAL ENGINE MANUFACTURER’S STANDARD WARRANTY PERIOD AND ANY
SPECIAL OR EXTENDED WARRANTY PERIOD ACQUIRED BY THE BUYER FROM THE ENGINE MANUFACTURER AT THE
TIME OF THE ORIGINAL PURCHASE OF THE ENGINE. EMP SHALL NOT BE LIABLE UNDER ANY CONTRACT OR TORT
CLAIM FOR PROXIMATE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER EXCEPT AS EXPRESSLY
PROVIDED FOR HEREIN.
IF OTHERWISE APPLICABLE, THE VIENNA CONVENTION (CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS)
IS EXCLUDED IN ITS ENTIRETY.
Note: Items replaced under warranty become the property of EMP.
This warranty is subject to the following:
Buyer Responsibilities:
During the warranty period, the Buyer is responsible for:

Providing proof of Buyer’s purchase date of the Oil Mate with Auto-shutoff and/or
proof of the original engine manufacturer’s warranty period and any extended or special
warranty period acquired by the buyer from the engine manufacturer at the time of the
original purchase of the engine.

Premium or overtime labor costs. |
 |
Return shipment charges in excess of those usual and customary. |
 |
Giving timely notice of a warranty failure and promptly making the product available for repair or replacement. |

Performing the following: |
 |
Visual checks of hoses, electrical connections, make-up tank level check and additions, and engine oil level at each refueling; |
 |
Maintaining oil level of make-up tank reservoir; |
 |
Submitting engine oil sample at each engine manufacturer recommended interval, maintaining oil samplerecords and acting on results of the analysis; |
 |
Contacting EMP if abnormal conditions appear; |
Limitations:
EMP is not responsible for:
 |
Failures resulting from any use or installation which EMP judges improper; |
 |
Failures resulting from attachments, accessory items and parts not sold or approved by EMP; |
 |
Failures resulting from stress, neglect and/or improper repair; |
 |
Failures resulting from Buyer’s delay in making the product available after being notified of a potential product problem; |
 |
Failures resulting from unauthorized repair or adjustments; |
